By uploading your Instagram photo with #ConteXme tags you grant COOO CONTE SPA and its affiliates a non-exclusive, free, irrevocable, worldwide, perpetual and transferable licence to use your name and photo tagged with #ConteXme (“User Content”) in any media including but not limited to on its web pages, social network pages, marketing, third-party materials, promotional materials, advertising and other commercial purposes. COOO CONTE SPA and its affiliates may use, reproduce, distribute, combine with other materials, modify and / or edit your User Content in any way without any obligations or additional permission on your part.
You represent and warrant COOO CONTE SPA that (i) you are over 18 years old, (ii) you own the right to transmit, distribute, replicate and publish User Content, (iii) you are the copyright owner or you have permission of the copyright owner necessary to grant the rights herein, (iv) you have the rights necessary to grant the licences described herein, (v) you obtain the consent of each person, if any, as indicated in User Content, (vi) you are the parent or tutor-at-law of each child under the age of 18, if any, as indicated in User Content, and (vii) User Content, as well as in relation to the use of User Content by the company CONTE SPA in accordance with these terms and that conditions do not violate and will not violate, unlawfully assign or infringe any intellectual property rights, publicity rights or other property rights of any third party.
You agree to indemnify, protect and secure COOO CONTE SPA from all costs, damages, losses and expenses, including attorney fees arising from any violation of any of the above statements and warranties.
You expressly exempt COOO CONTE SPA from any claims, losses, actions or obligations arising from the use of COOO CONTE SPA User Content as permitted herein.
If at any time you believe that any of the representations and warranties presented above is not true, you should immediately notify us of this by sending an email to smm@conte.by and indicating the User Content along with the explanation of the problem.
COPYRIGHT AND / OR VIOLATION OF TRADEMARKS
If you believe that any photo, image, or User Content posted on the Product Card section of www.conteshop.com violates your trademark, copyright or other intellectual property rights, send an email to smm@ conte.by containing the following information:
1. Identify your copyrighted work, trademark, or other law that you believe has been violated
2. Describe the allegedly infringing material posted on www.conteshop.com including the information on where the allegedly infringing material is located on www.conteshop.com and a permanent link where the materials are posted;
3. your address, phone number and email address;
4. your written statement that you have reason to believe that the impugned use is not authorized by the copyright owner or the trademark owner, its agent or the law;
5. your written statement made under penalty of perjury that the information provided above in your notice is accurate and that you are the copyright owner or trademark owner or are authorized to act on behalf of the owner; and
